Brazil Revises Registration Laws
The Admiralty Court of Brazil has passed an updated ordinance regarding registation procedures in the Brazilian Special Registry.
Godofredo Mendes Vianna of the Brazilian law firm Kincaid writes:
Court alters rule on registration of hulls or vessels
On October 10 2013 the Admiralty Court published Ordinance 50, which sets forth the procedures for pre-registration and registration of hulls or vessels in the Brazilian Special Registry, revoking Ordinance 0013/TM of June 19 1997. The new rule increases the list of documents that must be presented by the applicant to comply with one of the procedures.
It also establishes that at the end of the process, provided that no pending matters remain, the applicant will receive a registration or pre-registration certificate, with a maximum validity period of:
- 12 months in cases of pre-registration;
- three years for registration of bareboat chartered foreign vessels; and
-
five years for Brazilian vessels registered with the Admiralty Court or registered with the port captaincies.
The certificates may be renewed through an application by the interested party and compliance with the required documentation.
